Jack Smith made it clear in his introductory remarks about the indictment that Trump was and continues to be free to lie about the results of the election under the 1st Amendment, so long as that's all he's doing.

However, that's not ALL that Trump did.

As Smith lays out in the indictment, Trump knew he was lying and he was lying for the purpose of committing the crimes that are ennumerated in the indictment.

This is why Trump's lies regarding the 2020 election are NOT protected by the 1st Amendment.
