Carter thinks that TikTok is using biometric features to enforce COPPA. He imagines that TikTok is doing some kind of high-tech phrenology to make sure that every user is over 13 (“I find that [you aren’t capturing facial images] hard to believe. It is our understanding that they’re looking at the eyes. How do you determine what age they are then?”).

Chew corrects the Congressdunderhead from #Georgia, explaining that TikTok uses “age-gating”: “when you ask the user what age they are.”

That is the industry-wide practice for enforcing COPPA: every user is presented with a tick-box that says “I am over 13.” If they tick that box, the #company claims it has satisfied the requirement not to #spy on #kids.

But if COPPA were meaningfully enforced, companies would simply have to stop #spying on #everyone, because there are no efficient ways to verify the #age of users at the scale needed for general operation of a #website."

Furthering my thoughts on this, I hate the scapegoating and hypocrisy of this whole Congressional assembly. Why haven't they gone after Google's YouTube and Facebook's Instagram (and FB itself!) for the same excuse of "protecting the children"? I'll tell you why... Because the one flimsy reason of national security being somehow threatened by an app is not enough and 2) because TikTok happens to be beating FB AND Google in use of algs AND amounts of eyes on the screen.

Of course, no one is talking about the 10,000 or so OTHER mobile apps that happen to be made by Chinese developers. Or the fact that China could find even easier, more subtle ways to sway or subvert the American people through Facebook infiltration or other platforms or apps.

As a teen, I was listening to metal music back when it started being scrutinized and scapegoated for the ills of teen society. This was during the times of the Satanic Panic, where parents blamed metal music and its musicians for teen suicides and getting kids into occult practices. Musicians went before Congress to testify that music wasn't the culprit, but maybe we should be looking at how kids were being raised.

Now, we're seeing this very similar thing happening today. I would ask Congress if we're raising our kids right so that they look at what others do on the internet with a critical eye instead of admiration. Just because it's harder in this day and age to monitor what your kids are seeing, that does not mean you can blame it on someone else's creation, media or message.
