Lorie Smith as her frankly very basic web design company proactively sued Colorado for the right to say on said company website that she wouldn't make gay marriage websites. When Colorado moved to have the case dismissed in Federal District Court, on the grounds that nobody had ever asked her to do so, Lorie Smith and the "Alliance Defending Freedom" invented a gay couple asking for her to make a website. The couple literally does not exist. Stewart is a straight man who lives with his gf and wasn't aware of the case, and Mike has never been found. The case went all the way to SCOTUS, which decided that her 100% imagined grievance was legitimate.
#303Creative vs Elenis was a sham, and Lorie Smith should be ashamed.
CW: the news site linked to is running a fundraiser around abortion coverage, so the header when you land has references to rape and incest.
You know it'd be a real shame if Namecheap had to drop #303creative dot com and the various websites they've created, or even for the site to just exceed its bandwidth limits and require upgrades to a larger, much more expensive plan due to its popularity following the decision today. Of course, connecting to a popular website to check it out, and refreshing it frequently to ensure nothing has changed is certainly everyone's right.
I heard the entire #303Creative oral arguments before #SCOTUS and never once did Justice Alito’s lame attempts at humor cause me even to smile. But @karaswisher stopped me in my tracks with her tearful “rant” at the end of this episode covering gay discrimination in the marketplace. Prepare yourself.

Very very VERY important thread. Both practically and philosophically.
All of our liberations are intertwined.
White supremacist patriarchy is the enemy.

On Monday, the Supreme Court hears oral arguments in a case called #303Creative, an effort by @ADFLegal@twitter.com to overturn laws protecting LGBTQ people from discrimination.
I have a very important rule of thumb for you as you hear any of the discourse around this case... 🧵
The Supreme Court Is on a Doomed Crusade - The Atlantic by Ron Brownstein
‘Today's case showed why tension is certain to continue rising b/twn increasingly tolerant younger generations becoming the electorate's largest block & a GOP #SCOTUS determined to impose onto US cultural views of older white Christian minority. ‘

The GOP inadvertently making the case for why the US should have hate speech laws like every other secular nation does.

For people still finding my #303Creative thread, here was Alito suggesting kids in KKK costumes might try to have their picture taken with a Black Santa. 🤦♂️
Interesting question from Gerard Magliocca on one issue raised in #303Creative:
"[H]ow do you know whether someone is an artist as opposed to an ordinary business, which can be so regulated? Why isn't the answer 'if their work can be copyrighted?' This standard would distinguish, for example, a baker from a photographer. You can't copyright a cake--food is functional. You can, of course, copyright photos."

So, if I have this right, the issue in #303Creative is whether or not I can state that I plan to violate Colorado's law prohibiting discrimination based on sexual identity?
And the so-called "originalists" on SCOTUS are going to say that not only can I state that plan, but because I have that right I can also freely discriminate against people I hate?
Freedom for me but not for thee, the current conservative mantra.
Most certainly boycott #303Creative and any and all businesses/individuals that use it’s bigotry fuelled ‘services’.
Maybe if straight people boycotted them too they’d take the hint?

Once again, people forget that in Newman v Piggy Park, the racist owner of the barbecue place that would serve Black ppl but only if they picked up their food out back believed that “race mixing is against the will of God” and thus offended his religious belief.

This morning, Oral Arguments were heard at the Supreme Court, where web design agency #303Creative is arguing businesses should have the right to refuse service to same-sex couples, & anyone whose identities they disagree with.

This case shouldn't even be before SCOTUS
Nothing happened. No one filed suit vs. the Christian web lady.
Justices are trying to decide about hypothetical future cases. This Gorsuch line of questioning underscored it. They're clueless.
Ridiculous and dangerous. #303Creative
Then she adds in paid marriage announcements -- which changes the entire analogy.
The conservative justices are playing bait and switch and just trying to make the entire thing confusing and arbitrary, when it is not. #303creative
Ketanji Brown Jackson is really great at cutting through their bullshit, very powerful. #303Creative
Aside from the standing issue, the petitioner’s case seems… not good. In this #SCOTUS #303Creative case, the ADF’s lawyer Waggoner keeps saying that no one should be compelled to express a message that is against what they believe. And Justices Jackson and Sotomayor are following that thread, and it seems like the petitioner is just saying yeah, anyone can discriminate! So tl;dr it’s a case with iffy standing and a hypothetical injury being used to undermine anti-discrimination laws
