Judge Edith Jones of the U.S. Court of Appeals argued in a letter to the WSJ that the circumvented the “usual process” in its probe of Judge Pauline Newman’s mental fitness and her alleged failure to cooperate with investigators.

Newman, 96, has allegedly shown bouts of memory loss, confusion and paranoia. A 3-judge panel is seeking to suspend her for one year or until she submits to a court-ordered examination.

The 5th Circuit has filed a substitute opinion and withdrawn the one it issued in United States v. Rahimi at the beginning of February. One material change in the opinion relates to the government's argument that historical laws disarming persons perceived at the time to be dangerous (enslaved persons, Native Americans and persons who refused to take oaths of loyalty). ca5.uscourts.gov/opinions/pub/

Legally, it is unlikely that the will reverse the vacatur in the Texas case. And despite the more expansive views of standing expressed in both cases, THIS Supreme Court is not likely going to step in to block either the 5th Circuit or the 8th Circuit decision in these cases.

Yes, the flexibility of the judiciary's standing doctrine has often seemed to depend, indirectly, on some judges' views of the merits of a case. Which shouldn't happen. But not much to be done about it here.

Per @stevenmazie, today granted certiorari in Dubin v. U.S.

The issue: if a person uses another person's name in the course of committing fraudulent transactions, WITHOUT making misrepresentations about anyone's identity, is that enough to support an conviction?

District judge said yes, but also that he hoped he would get reversed. The affirmed (both panel & en banc). What will SCOTUS say?
