Das ist mal wieder ein richtig schlechter #Heise-Artikel zu den aktuellen Akvititäten der aktuellen EU-Gesetzgebung im Kontext #Datenschutz (#DataAct #DA, #DataGovernanceAct #DGA, #ArtificialIntelligenceAct #AIA)

Die Überschrift des Artikels lautet: "EU-Datengesetze: Europas Datenstrategie krempelt den Datenschutz um"

Die Überschrift ist inhaltlich falsch. Inhaltlich wäre richtig: "Datenschutz soll in Europa weiter aufgeweicht werden." Und Herr Voss (CDU) ist wieder ganz Vorne mit dabei.

Im Teaser steht weiter: "Statt nur persönliche Daten zu schützen, sollen sie diese auch nutzbar machen." So ein Unfug kommt zustande, wenn man inkompetent drauflos und von "Datenschutz" schreibt, aber eine Schlichtvariante von "Privacyschutz" vor Augen hat.

Datenschutz hat IMMER schon der Nutzbarmachung von Daten gedient. Nur dass deren Nutzung unter rechtstaatlichen Bedingungen erfolgen soll (Bedingungen aus abstrakt GrundrechteCharta und operationalisiert DSGVO) im notorisch problematischen Verhältnis von Organisationen und Personen. Organisationen bestimmen über die Zwecke und Mittel (IT, Infrastruktur) dieses Verhältnisses. In modernen Gesellschaften gilt die verfasste Zusage an Personen, dass grundsätzlich Augenhöhe zw. Organisation und Person besteht und in den Fällen der strukturellen Machtasymmtrie Organisationen sehr vorsichtig und regelgeleitet mit ihrem operativen Privileg umzugehen haben. Es besteht da überhaupt kein domänenspezifisches Regelungsdefizit, das durch die drei Acts nun zu beheben wäre; die DSGVO leistet bereits genau das, auch für Plattformen, auch für Bitcoin und KI. Nein, es ist der Grundrechteschutz allgemein, der den großen IT-Playern natürlich im Wege steht. Ja auch im Wege stehen soll! Wenn Datenschutz in der EU noch weiter wegbricht, brechen die letzten Reste der Moderne weg. (These: Und dann ist auch das Klima nicht mehr zu retten, weil die Trivial-Lösungen zur Energieversorung implementiert werden.)
