I wish the families well in their legal action: it seems pretty clear that many people died unnecessarily as a result of the government's negligence.

But honestly I wouldn't give much for their chances of success. The government gets to make the rules. They're not going to make the rules so that they can actually be held accountable if they kill people, are they?
