BREAKING: DA Stephanie Bridgett is asking Judge Flynn to take the dismissal of the #ZoggFire case, without prejudice-- pending a CIVIL agreement between the prosecution and PG&E.

This is similar to what happened in the #KincadeFire and #DixieFire last year, when 6 DAs settled their criminal investigations.

A lawyer representing property owners is objecting, arguing the deal affects potential restitution payments to his clients.

@brandonrittiman For what it's worth, McNeil also inspected and analyzed the damaged Douglas fir that, along with PG&E's slow response, started the 2021 #DixieFire. PG&E insisted the tree had been inspected and was sound. Among McNeil's conclusions was that the base of the tree was seriously weakened from prior incidents, including a 2008 fire, and that "a cursory visual inspection of the base of the tree would almost certainly have revealed the extensive decay." #ZoggFire

PG&E has defended past accusations of wrongdoing by pointing out trees that fell on its power lines were "alive and vital." (This was a line of defense in the massive 2021 #DixieFire, for instance.)

In the #ZoggFire manslaughter hearing, arborist McNeil says: "Trees that are alive and vital may have significant mechanical defects that make them more prone to different types of failures."
