: "The approach works for larger outlets, but is awful if you are a smaller community outlet that produces news content with relatively fewer full time journalists. The smaller outlet may have a relatively comparable impact (accounting for size), but will receive less compensation under the Bill C-18 system. Moreover, given the 20% band requirement, the platforms can’t pay the smaller outlet more without raising the rates paid to the established players. The end result will be to entrench the more established outlets, while making the smaller, independent and digital-first outlets less competitive. During the Bill C-18 hearing, Liberal MP Lisa Hepfner stated that online news wasn’t real news. The Bill C-18 draft regulations reflect that attitude, rewarding the large lobbying groups and continuing the harmful effects of the Online News Act for many media stakeholders."

: "A growing number of news organisations have set up specific guidelines to govern how they use artificial intelligence (AI). This article analyses a set of 52 guidelines from publishers in Belgium, Brazil, Canada, Finland, Germany, India, the Netherlands, Norway, Sweden, Switzerland, the United Kingdom, and the United States. Looking at both formal and thematic characteristics, we provide comparative insights into how news outlets address both expectations and concerns when it comes to using AI in the news. Drawing from neo- institutional theory and the concept of institutional isomorphism, we argue that the policies show signs of homogeneity, likely explained by isomorphic dynamics which arose as a response to the uncertainty created by the rise of generative AI after the release of ChatGPT in November 2022. Our study shows that publishers have already begun to converge in their guidelines on key points such as transparency and human supervision when dealing with AI-generated content. However, we argue that national and organisational idiosyncrasies continue to matter in shaping publishers’ practices, with both accounting for some of the variation seen in the data. We conclude by pointing out blind spots around technological dependency, sustainable AI, and inequalities in current AI guidelines and providing directions for further research."

First, signing agreements does not result in an exemption from the law. Unlike the Australian law – which did grant the government the ability to grant an exemption under the law – the Canadian law does not adopt the same approach. So long as Google and Meta facilitate access to news content (ie. link to it), they will be treated as digital news intermediaries (DNIs) under the law and there is no available exemption. This means that the many rules in Bill C-18, including codes of conduct, disclosure requirements, rules governing the display of news content, etc. are likely all applicable to them regardless of the existence of negotiated agreements. Simply put, when St-Onge claims the companies would be exempt under the law based on agreements that could be signed over the coming months, she is wrong."

If a federal judge finds that OpenAI illegally copied the Times' articles to train its AI model, the court could order the company to destroy ChatGPT's dataset, forcing the company to recreate it using only work that it is authorized to use.

Federal copyright law also carries stiff financial penalties, with violators facing fines up to $150,000 for each infringement "committed willfully."

I don't think that a works the way that a lot of smaller think they do.

I am sure in their heads they think: "Well if somebody finds this interesting, they will sign up and give us money so that they can read it".

In reality people just cut-and-paste the headline into Google and find another source.

Just drop the paywalls and go the ad-route; it's not 1960.
