Le prétexte pour ce loi est que le français est en déclin au Québec, un problème grave si vrai. Mais ce declin n'est pas de tout évident. Honte à la #CAQ qui a pris des mesures rendant les vies des Québécois plus difficile, sans justification que ces mesures résoudront des problèmes.

En fait, n'importe si les modifications de la Constitution ont un effet juridique, c'est certain qu'elles ne changeraient rien par rapport à la proportion des Québécois avec le français comme langue maternelle.

What does #StéphaneDion think about #ProjetDeLoi96 ? In favour: “As long as it is clear that the constitutional rights of Anglophones are not affected, nor any other provision of the Constitution, the prime minister has no reason to oppose it,”
But he favours a #SupremeCourt reference, to be certain about the effects of the "nation" clause.

I *think* that Trudeau ministry will follow that approach: say that they support the amendments in theory, but they're unsure what amending formula would be applicable, and rather than leave the constitutional validity questionable, they will send the issue for a reference judgement from the courts.
That would stall the whole matter as well.
I *think* that's what they'll do, but at a confidence of around 50% : more likely than other actions.
Could "The Yellow Birch is the official tree of Québec" be added to the constitution of Canada unilaterally? Yes. Could "The Montréal Canadians win any game tied after the 1st overtime" be added unilaterally? No, it affects other provinces. Are the proposed amendments like the former or the latter? Maybe we should ask the courts what they think.

The proposed constitutional changes are:
90Q.1. Quebecers form a nation.
90Q.2. French shall be the only official language of Quebec. It is also the common language of the Quebec nation.
I reject the first clause (and thus the second sentence of the second clause). I'm open to declaring French the only official language of the province of Québec, though I'd like some assessment of the consquences of doing so in the constitution.
Ah ha! An analysis of whether the government of #Québec can unilaterally amend the Canadian #constitution. The answer is yes, for laws that amend the constitution of that province (i.e., do not affect other provinces).
However, according to the article the first proposed change would affect other provinces; and the second affects language rights protected elswhere in the constitution. At least the feds would need to assent.

W.r.t. #ProjetDeLoi96 , there is a real matter of concern: the percentage of Quebeckers with French as a mother tongue is falling (slightly) and is now is under 50% of households on the island of Montréal (though that's because of allophones, and it's not necessarily a threat to French).
I'm not sure that anything in the new bill really will have any effect on this supposed problem.
@fssofdeath Why do you think this has something to do with Bill 21? That law was popular with CAQ supporters, was enacted using the notwithstanding clause, and has mostly survived its first test before the courts. Seems like it's a fait accompli (or a "promise made, promise kept") at this point in time.
(FWIW, I opposed Bill 21.)
I see #ProjetDeLoi96 as a populist attempt to address francophone insecurity about French.
