Particularly when the data to (algorithmically) identify vulnerable consumers is sitting *right there* in the engagement data.
They'd need to argue that radicalization was a technical danger that was not obvious to the average consumer, and that it could have been avoided through alternative algo design....

But I also have to wonder whether, at some point, someone isn't going to find a way to bring action against algorithmic recommendation systems based on a design defect theory of product liability.
It seems plausible to me that one could argue that the makers of these systems were aware of safer alternatives that would moderate the algos' relentless engagement-mining....
