#DOJ has filed its reply brief in the #Trump #MarALago #SpecialMaster appeal before the #11thCircuit.

I'm not going to do as deep a dive as I did with Trump's appellee brief last week, mostly because the points DOJ makes, by and large, are neither new to the case nor obviously incorrect.

But let's look at some of it.

@emptywheel catches this issue before #SpecialMaster Dearie in the #Trump #MarALago suit: a dispute over a "compilation" document featuring both classified docs & nonclassified post-45-presidency docs.

The *existence* of this "compilation" is perhaps more significant than the dispute over its status, since "it shows he was commingling stolen classified documents with his ongoing affairs after leaving the White House."

Still chuckling that #Trump lawyers (and Judge #Cannon) argued that a court can get a #SpecialMaster involved if constitutional rights were NOT callously disregarded.

The argument that precedent doesn't REQUIRE this factor, and that its "indispensability" is limited to Richey alone, is refuted by actually *reading* Chapman.

And if Trump were right, cite a case where the party got a special master with NO showing of callous disregard! Oh, you can't? Hmm...

While we wait for the #Trump merits brief before the #11thCircuit to be filed today, we will also soon be seeing partially-redacted "global issues briefs" from both parties raising issues to be considered by #SpecialMaster #Dearie.

The unredacted versions have already been filed, and pursuant to a process approved by Judge #Cannon, the parties have asked to unseal the redacted version. I'd expect that to be granted today.
