Law Professor @pamelasamuelson has weighed in on the two lawsuits and has opined that the California one (Andersen v. Stability AI Ltd., 3:23-cv-00201, (N.D. Cal.), courtlistener.com/docket/66732) is the easier one to defend because the plaintiff shoots themselves in the foot with respect to copyright infringement (Complaint, Doc 1, p. 21, ⁋ 93).

The Delaware care (Getty Images (US), Inc. v. Stability AI, Inc., 1:23-cv-00135, (D. Del.) courtlistener.com/docket/66788) is harder because it is multi-pronged, better written, and is not in the 9th District where many nice precedents with respect to web crawling were written.

Also, if it goes to a jury, won't the layman place weight on any allegations there were attempts to sand off Getty Images watermarks or demonstrations that garbled watermarks sometimes are generated?

What's harder to imagine is a process to agree on what the fair price for training a model on a curated set of data like the Getty Images which are particularly valuable due to the extensive textual labels which are inputs to the training of generative AI which is responsive to natural language prompts.

Stability hopes to repeat the catalyzing effects of its Stable Diffusion open source image synthesis model, launched in 2022. This is a great deep dive into the reasons why the lawsuit three artists filed against Stability AI and DevianArt is nonsensical and, also, opposed to many ideas and rights that protect artists.

The lawsuit would set precedent to expand copyright in weird and silly ways if it were to succeed.

Also, the part about the Anti-SLAPP was eyebrow raising. I'm skeptical that will take but if it does, I do feel bad for the plaintiffs.

@seldo I think lawyers argued that under 9th Circuit law, a derivative work has to be substantially similar to be an infringing work. Neither the trained models at issue nor the output from that model has been shown to be substantially similar to any particular training image.

So you may be arguing for the existence of an alleged moral right that the law does not recognize today.
