Any #tax #TaxLaw #IRS experts, attorneys, #CPAs here who can answer a question *definitively*, i.e. by citing the IRS' rules about when a #W9 form is needed?
My day job is running a licensed cannabis nursery in NorCal (Plant Humboldt). We sell starter plants to farms and personal use growers. We mostly grow from seed, but sometimes buy rooted cuttings to grow out from other licensed nurseries. We keep getting requests from them for W9s, which IRS says we don't need (best as I can tell and according to the IRS person on the phone). We are not dealing in cash and there are no 8300 forms involved. It's all checks, credit card payments or direct bank to bank wire transfers. There is no logical reason why a W9 is necessary.
On an FB legal weed business forum, everyone insists that getting a #W9form is "normal*, but no one can say where it says required. The ones who say it's required also can't show me where it says that.

The US Supreme Court will hear an attorney-client privilege case on Monday. This case is related to the “advice” by a “law firm” specializing in international tax law involving the cryptocurrency assets of a “company.” Many documents are under seal. The briefs do not disclose the company’s or the law firm’s names but reveal that “the owner of ‘company’ is an ‘early promoter of bitcoin’ who ‘expatriated from the United States in 2014.’”

Shout-out to whoever in IRS Passsthroughs and Special Industries write General Legal Advice Memorandum 2018-002 got this in there:
"Thus, the investor's economic return - that is, independent of Tex considerations - generally will increase or decrease depending on how the wind blows."
Might not sound like much but getting anything that even seems like it *could be* worldplay into IRS Chief Counsel legal writing is a feat.
I'm surprised I haven't thought of this yet but a 100% no joke good use of ChatGPT is writing IRS letters.
"Letters from the IRS!" say the blissfully ignorant. "Surely that's not something we want to trust to a computer that frequently gets key details wrong."
But sadly IRS letters *are* written by a computer that frequently gets key details wrong.
Except the computer was built in the 1960s and--I swear this is not a joke--stores data on magnetic tape.

I'm generally opposed to windfall taxes on fossil fuels on principle -- a windfall tax is a one-time tax on profits thought to be, for extraneous reasons, unrelated to actual market performance. Stuff like, say, the Russian invasion of Ukraine causing energy prices to skyrocket.
But with fossil fuels, the long term effects are much more widely felt, and taxes should be keyed to those costs.

"If the government is going to force taxpayers to engage with private entities for #tax preparation ... it should at least ensure it’s also not forcing said taxpayers to engage in the #data economy. If advertising and data harvesting models are permitted in the tax preparation space, they will compete with and best options that derive revenue purely from use of the service."
