If so, what if individuals proactively collect a list of patients entering a clinic… is that a HIPAA breach?

If #Amazon has been using that to track people then that data could be subpoenaed & used for prosecutions. This is the problem with reckless data collection in general: once it has been collected it can always be leaked, exfiltrated, or subpoenaed.
