@sharoz right, that's the part I'm a bit uneasy with. I understand your point, but it's also the case that the open science "movement" doesn't have a great track record in this respect. There's a reason #bropenScience is a thing, e.g.. So I'm not as convinced as you seem to be that a public list of "papers that aren't doing open science right" is entirely unproblematic from an ethics pov, and I think open science that grapples carefully w ethics is better.
