The Supreme Court has set up a new constitution bench to hear petitions related to Article 370 of the Constitution, which granted special status to Jammu & Kashmir. The bench, headed by Chief Justice Dhananjaya Y Chandrachud, will begin proceedings on July 11 after a gap of over three years. One of the petitions to be heard is from Shah Faesal, a bureaucrat who initially challenged the abrogation of Article 370 but later withdrew his petition. The case is expected to issue procedural orders for a future hearing date.

Why are India’s lower courts so reluctant to grant undertrials bail?

Trial court judges can face backlash for being liberal while giving bail, including complaints, career setbacks and adverse remarks from the higher judiciary.

Even though bail is supposed to be the rule and jail an exception, this principle is not followed in practice. Courts, especially trial courts, are slow to grant bail, resulting in three out of every four prisoners being undertrials. A majority of these prisoners may not required to be imprisoned.
