They don't "take" content from news #producers. They show an #extract - a #snippet, maybe just a #headline - with a #link back to the original news site for people to follow. This is classic fair use under #copyright; FB etc don't get a ton of value out of it. The news sites get #traffic - lots of it - to try to monetize.

If FB etc were copying articles wholesale, *that* could kill the news sites - but it would also be a blatant violation of copyright. It isn't happening.

After deep diving on #Warhol, if it means what it says I really think lots of generative #AI players (at least at certain points in the supply chain) are running non-trivial #copyright risk. The new atomistic purpose analysis tees up lots of pretty obvious substitutive overlaps between training data and AI-generated works; substitution is essentially the sales pitch. Query, OFC, whether the fact that it's less work-to-work and more aggregate/industry-wide substitution makes it better or worse.

Teaching #copyright this semester is a good reminder that there is a serious frog-boiling problem in IP. People talk about copyright like it's some kind of well-reasoned and founded enterprise, and there certainly is an endless parade of case law. But almost nothing is coherent or consistent or cleanly moored to constitutional principles. Almost every doctrine is framed by cases bursting at the seams with amateur art criticism, bias, intrinsic and extrinsic contradictions, and vibes-determinism.
