States banning software is dumb. States passing their own unique data privacy laws is also dumb. But Democrats controlled the last Congress, had a bipartisan national privacy bill (the #ADPPA) and the Democrats killed it. #uspol #DataPrivacy

Facebook/Metaโs and its law firm Gibson Dunn were fined and sanctioned by US Courts for their terrible and obstructive conduct during the now settled #CambridgeAnalytica class action #DataPrivacy lawsuit in California. Read the actions of bad actors who successfully stonewalled the system and shielded Zuckerberg and Sandberg from depositions, when money was no object and the lawyers were willing to act badly to help hide the truth. https://storage.courtlistener.com/recap/gov.uscourts.cand.327471/gov.uscourts.cand.327471.1104.0_1.pdf

The DoJ's lawsuit against Google for illegal monopolization of digital advertising dropped last week. It's a 150-page document :allthethings:
๐ Here's my first attempt to unpack what is probably one of the most complete antitrust cases in ad tech of the last decade. My focus? ๐ How three ad pricing manipulation schemes described in the suit hurt publishers: #digitaladvertising #dataprivacy #Google #techpolicy https://techpolicy.press/how-google-manipulated-digital-ad-prices-and-hurt-publishers-per-doj/

Reconnecting to work & digital happenings today, and so here is the one thing in #dataprivacy to know this week:
1. Meta's ad business (its only business) needs a new legal pathway to exist in Europe, after EU data protection authorities found Meta's "compliance" to GDPR was, well, not compliant at all: https://www.politico.eu/article/meta-fina-ad-business-model/
Just as I had read the headline "Metaโs Ad Practices Ruled Illegal Under European Union Law", my FB tab auto-directed to this site.
THANK YOU GDPR & data rights regulators!
๐ฐ ๐บ๐ธ In June this year, the FTC announced it would revamp enforcement of the Childrenโs Online Privacy Protection Act (COPPA). Today, it announces the results of an investigation into Epic Games #dataprivacy practices, as well as unfair practices that deceive consumers, such as the use of dark patterns to mislead users into making unwanted in-app purchases. The FTC w/the DOJ reached a record settlement with Epic Games for $520 million for all charges: https://www.ftc.gov/news-events/news/press-releases/2022/12/fortnite-video-game-maker-epic-games-pay-more-half-billion-dollars-over-ftc-allegations

๐ฌ A few thoughts on today's news that #Google reached a $300MM+ settlement with 40 state AG for tracking users' location without their knowledge:
1. The case adds up to how Big Tech is coming to a reckoning with privacy rights.
2. BUT it will not fundamentally correct that behavior. The only change is that now users have to be notified about it ๐คท๐ฝโโ๏ธ
3. THUS, federal #dataprivacy laws that actually restrict this practice are required. We cannot protect was is not an enshrined right (yet).
On #dataprivacy news today: Huge settlement between Google and 40 state AGs on a lawsuit that revealed how Google misled consumers into believing that by turning off location tracking, it would not continue to collect data about their movements through other services (search, maps, and other apps that connect to wi-fi phone towers): https://www.nytimes.com/2022/11/14/technology/google-privacy-settlement.html?unlocked_article_code=yZUQ8l6PDuW7gRakKWTeHCqAG9LMuewTaZEfvYCWNne7ZRG-LqBNY-EAJGZdvVJAMe7EFuO7XXSaMSyqKz0gVFEdOgF_pv72B7VfkkZK_olz6LhjHGki-UOdsq1jGKFTcySn9R-XC6fucnwSEqgtba4rmzas7sQDJ3WjCFfkPtPxdEx4cYHku_pqMRjsbAuxLWFJ4IOScSWDhQAS28A26omg9Q-kE8k6x1nWtTQAwYTKv2bhoQVfwczUvb1t4KgyeYywhJ8WaUyqykODBQEulq1BjFi9QT6kONa1KJiMjqjjrx2EI_tIFc0AK30i0g4F25QYagc_iKz-62bK8VWvmXHHWPoKbQ&smid=share-url

๐ฐ Good Friday everyone! For anyone following #digitaladvertising #dataprivacy intersections, there's something to be said about how new rules in digital advertising are reshaping competition among American retailers, in ways that help drive more market consolidation. The latest example? The Kroger-Albertsons proposed merger.
