These decisions are retroactive, which means there was no legal basis for said transfers between the year 2000 and 2023. Nevertheless, most EU companies kept using services like Google Analytics or tracking tools by Meta which entail unlawful data transfers to the USA. A new analysis of noyb's 101 complaints on that matter now shows how a combination of inactive data protection authorities and new deals by the European Commission have lead to 23 years of privacy violations."

The allegedly "new" Trans-Atlantic Data Privacy Framework is largely a copy of the failed "Privacy Shield". Despite the European Commission's public relations efforts, there is little change in US law or the approach taken by the EU. The fundamental problem with FISA 702 was not addressed by the US, as the US still takes the view that only US persons are worthy of constitutional rights."

The only unknown is the transfer aspects. Until the EDPB says otherwise, I am acting under the assumption that data transfers are not occurring outside of the EU between my instance and those hosted in inadequate countries.
