I'm seeing stories about how #studentdebt #studentloan holders see a path to relief via #bankruptcy because of the new DOJ / DOE guidance. I'm very skeptical. Besides cost to file, the undue hardship requirement remains the prerequisite to discharge. That DOJ / DOE has made it clearer how a #debtor can show undue hardship, it only applies to a sliver of people with student debt. Plus BK judges have the ultimate say. In some courts, undue hardship discharges may increase; in others, probably not.
