"The copper smelter in -- located between the , and Apaches Sacred -- is the third in the United States for producing toxic air pollution causing cancer. The poison air means the central Arizona community of Miami has ten times the EPA's acceptable risk of cancer. "After hearing about the Cop City arrestees, journalist Will Potter, author of Green Is the New Red, said it “feels like flashbacks”. Potter’s book details the federal government’s legal campaigns against animal rights and environmental groups such as Earth First and the Animal Liberation Front, in the 1990s and 2000s.

“From my reporting on the history of government tactics,” he said, “fear is always used to send a message to the larger movement – and also to tie up energy, momentum, money and time.”

The idea, Potter said, is to marginalize dissent; his research has led him to doubt “if the charges actually matter” to the state. “I’m not convinced … the plan is to solve a crime, or to protect the public,” he said. “It’s all political theater.”

"The Thacker Pass protesters who were hit with a lawsuit filed by Lithium Nevada are seeking to get the case dismissed. The defendants last week filed a motion to dismiss the case claiming they were exercising their right to free speech.

"Lithium Nevada, which is building the Thacker Pass lithium mine, sued the protesters in late June.

"The company said activists and members of the Fort McDermitt Paiute Tribe have attempted to block construction at the mine site.

"'Despite multiple warnings from law enforcement not to block public roads, Defendants have continued to do so,' the lawsuit alleges. 'Indeed, Defendants have proudly broadcasted their defiance of law enforcement on social media.

"The defendants disagreed with Lithium Nevada’s claims.

"'The Defendants opted to exercise their constitutional rights and went to the Mine site to pray for their ancestors as destroyed those ancestors’ final resting places, destroyed culturally significant lands formerly used for subsistence and self-preservation,' they wrote in their motion. 'It is appropriate to analyze whether LNC has established the elements of its claims for relief within the limitations imposed by the First Amendment.'

"They also disputed LNC’s claims of violence and vandalism.

"'As a site is being bulldozed, non-violent protesters are being criminalized by a foreign mining company,' said attorney Terry Lodge, representing the defendants. 'My clients were engaged in that is clearly protected by the U.S. Constitution. This is greed and bullying.'"

"The science is clear: the warmer the oceans, the stronger the storms. Heat is energy, and the more of it there is in the ocean, the more fuel for increasingly destructive storms. At the same time, rising sea levels, caused by the melting of the South Pole’s ice caps and Arctic glaciers, mean higher storm surges.

"I don’t have to tell you that storm surges are the deadliest part of a hurricane making landfall. They occur when a storm pushes a wall of seawater several feet high onto the land, causing lethal flooding and costly property damage. In , I saw the city’s Lower 9th Ward all but razed by fierce ocean waters. Residents evacuated as far as other states; nearly two decades later, many have never returned.

"Tragically for Louisiana, the state has 740 plants that are vulnerable to tropical storms, according to a new report by The Times-Picayune and The Advocate. While most have weathered storms in the past, there’s no evidence to show they will be able to withstand the storm surges of the powerful that are becoming the new norm.

"It’s outrageous that plant owners can put the health and safety of some 1.2 million Louisiana residents at risk. The rest of us understand we need to undertake additional precautionary measures now that hurricane season is becoming increasingly deadly. Petrochemical companies should not be able to put us in harm’s way by denying this reality."
