Dissenting in this case, Justice Thomas continues to suggest that qui tam ("private attorney general") statutes, line the one in the , are unconstitutional under Art. II. And it looks like Barrett and Kavanaugh are flirting with this theory as well.

Still fringe (it IS Justice Thomas after all), but this might be worth keeping an eye on.
