The pirates became admirals, and set about creating a "#FelonyContemptOfBusinessModel":

They changed the rules to ensure that they could "disrupt" anyone they chose, but could themselves mobilize the full might of the US government to prevent anyone from disrupting *them*:

People For Bikes, the main bicycle industry lobbying group, is trying really hard to keep ebike repair tools and manuals out of the hands of independent repair shops through carveouts for ebikes from right to repair laws on the grounds of battery safety.
This is very similar to the tactics used by car companies to keep car owners locked to dealerships for repairs.
Yes, batteries can be dangerous. But what's even more dangerous is that people will improperly dispose of broken bikes
when they don't have access to the documentation and diagnostic tools manufacturers make, but only license to official shops.
Besides the battery thing is a big red herring. The stuff they're holding back isn't battery repair tools, it's documentation of everything else like controllers and throttles and sensors. They would rather brick your bike than let you have control over it. #RightToRepair #Ebikes #FelonyContemptofBusinessModel

When Apple says, "You can't install a third party app store on your phone," what they means is, "it's *illegal* to install that third party app store." It's not a *technical* countermeasure that stands between you and #TechnologicalSelfDetermination, it's a legal doctrine we can call "#FelonyContemptOfBusinessModel":
https://locusmag.com/2020/09/cory-doctorow-ip/
But the mighty US government will not step in to protect a company's business model unless it at least *gestures* towards the technical.

But when *we* tried to twiddle back, that was "#FelonyContemptOfBusinessModel," and the airlines sued:

And sued:

Platforms don't just hate it when end-users twiddle back - if anything they are even more aggressive when their business-users dare to twiddle.

Yes, Apple will block Facebook from spying on you - but even if you opt out of tracking, Apple still spies on you in exactly the same way Facebook did, to power their own ad-targeting business:

This is what Jay Freeman calls "#FelonyContemptOfBusinessModel" - the literal criminalization of configuration.

@pluralistic I think #FelonyContemptOfBusinessModel is a special case of what cartoonist Steve Bell used to refer to as "Conspiracy to Offend The Money".

When they used adversarial interoperability to build a multi-billion-dollar global company using the movie studios' products in ways the studios hated, that was *progress*. When you define "family" in ways that makes Netflix less money, that's #FelonyContemptOfBusinessModel.

This all adds up to what Jay Freeman calls #FelonyContemptOfBusinessModel, an abuse of copyright law that allows a monopolistic corporation to reach beyond its own walls and impose its will on it customers, critics and competitors:

If Deere was finally suing for peace in the #RepairWars, well, that was wonderful news indeed - as I said, a seeming miracle.
But - like all miracles - it was too good to be true.

Laws like #Section1201 of the #DigitalMillenniumCopyrightAct (#DMCA) and #Article6 of the #EUCopyrightDirective (#EUCD) make it illegal to jailbreak a phone to install third-party apps. Jay Freeman calls this #FelonyContemptOfBusinessModel - that is, the government will punish your competitors for trying to compete with you. Nice work if you can get it.

Big Car invented VIN-locking.
VIN-locking is the major impediment to securing the #RightToRepair. Manufacturers of all kinds bootstrap the DMCA - a Clinton-era copyright law - into a new doctrine that Jay Freeman calls #FelonyContemptOfBusinessModel." Removing DRM is illegal, so any business model that hides behind DRM is illegal to thwart:
