With h/t to @jvagle for drawing out the point, I think one possible takeaway of yesterday's #Section230 oral arguments is that some of the Justices who might be politically inclined to upend 230 (Thomas, in particular) came to the realization in realtime, amplified by the petitioner’s and SG’s bad arguments, that #Gonzalez is a much worse vehicle than advertised for advancing judicial reform of 230. The terrorism atmospherics are sort of helpful, but it's a bad case for the contribution issues.

Big Tech has created this crazy idea that all algorithms are equivalent, come out of the same black box, and either you have algorithms or you don’t, but this is false dichotomy.

Algorithms can be designed responsibly or irresponsibly.

I support #Section230 defenses in #Gonzalez, but I do have to wonder whether someone will eventually succeed in raising a design defect product liability case.

Particularly when the data to (algorithmically) identify vulnerable consumers is sitting *right there* in the engagement data.

They'd need to argue that radicalization was a technical danger that was not obvious to the average consumer, and that it could have been avoided through alternative algo design....

I applaud all the defenders of #Section230 who filed amicus briefs in #Gonzalez.

But I also have to wonder whether, at some point, someone isn't going to find a way to bring action against algorithmic recommendation systems based on a design defect theory of product liability.

It seems plausible to me that one could argue that the makers of these systems were aware of safer alternatives that would moderate the algos' relentless engagement-mining....
