Defunding government employees under the Holman Rule is unconstitutional following the U.S. Supreme Court's ruling in United States v. Lovett .

The Court held that any rule that imposed such a penalty was no "mere appropriation measure", but was effectively a bill of attainder prohibited by Article I, Section 9, of the Constitution.

It denies due process by accusing someone of a crime, finding them guilty and then punishing them .
