@ABecenti also important—as Gorsuch's concurrence notes—is that the claims made by the Goldwater Institute (ugh) don't hold water. The #ICWA was a reaction to a deliberate and ongoing program of harm.

In the case Haaland v. Bracken, he #UnitedStates #SupremeCourt today upheld the federal #IndianChildWelfareAct (ICWA) by a 7-2 margin, a 1978 law that gives tribal governments exclusive jurisdiction over #Native children who live on reservations. Considered to be the “gold standard” of child welfare policy, #ICWA has protected the continued existence of Indian tribes and their most vital resource — Indian children — for 45 years.

#ICWA lives to see another day, thankfully. But the possibility of #EqualProtection challenges remains.

Hell, #Kavanaugh all but draws a roadmap for would-be petitioners to bring an EP challenge.

And the close of #Thomas's dissent -- drawing a fine distinction between refusing to disturb a finding that ICWA is constitutional and "deciding that
ICWA is[] in fact" constitutional -- implicitly embraces a case brought on those grounds.

Gorsuch, who was largely raised in the West, often sides with Indian tribes in disputes that reach the high court. On Thursday, he wrote an opinion concurring with the majority to underline the importance of the law to the tribes, a ringing endorsement of tribal sovereignty.

“Our Constitution reserves for the Tribes a place – an enduring place – in the structure of American life,” he said, adding that it “promises them sovereignty for as long as they wish to keep it.”

Today's #SCOTUS decision upholding the #ICWA lets us breathe a sigh of relief, at least for now. It could well have gone the other way.

But this #Propublica article is a sobering reminder that, even with ICWA in place, there are significant obstacles to protecting the remaining statutory rights of Indigenous families in the US.
