The has rejected the theory. The court rules that state constitutions can protect in federal and state courts can enforce those provisions, a key opinion that should safeguard 2024 .

Lawyers tried to use the theory to sway the outcomes of the 2000 and 2020 elections. What if it were to become the law of the land?

How do you find a "middle ground" with respect to eviscerating the workings of individual state governments? This notion of the is nonsense. abajournal.com/news/article/3-

The potential consequences of attempting to establish permanent minority rule through the Independent State Legislature Theory could be devastating. If Americans are denied the right to a peaceful resolution to political issues, then violence may become unavoidable.

This is the same theory Ginni Thomas was pushing when she was trying to overturn the 2020 election with John Eastman.

If her husband (Justice Clarence Thomas) and four of the other right-wing extremists on the Court agree, Ginni will have won.

If there ever was an actual 'Stop the Steal moment, this is it. States with Republican supermajorities could use their power to entrench themselves and prevent Democratic victories, even at the presidential level. It is essential to push back against this corrupt interpretation and protect the integrity of our electoral process.

The case before SCOTUS today, Moore v. Harper, could be the end of the line for American-style democracy.

The “independent state legislature theory” would empower state legislatures to overturn the will of the voters in any election.

This case will certainly test the legitimacy of the Court. Will the Court fundamentally change what "democracy" means in the U.S. context?

The fact that they are hearing the case on Dec 7 - Pearl Harbor Day - adds insult to injury.
