Microsoft has heavily invested in AI through products like GitHub Copilot and Bing Chat that can generate original code, text, and images on demand. Its AI models have gained these capabilities by scraping publicly available data off of the Internet without seeking express permission from copyright holders."

Really enjoyed this piece about how using the term "Intellectual Property" causes harm, when trying to think about the problems with very different types of laws, such as patent laws, copyright laws, and trademark laws. The term "Intellectual Property" incorrectly and falsely puts non-economic human problems into an economic perspective.

Hmm, specifically emailing me about "changes to terms of service" makes me nervous. I'm not a lawyer, but MIcrosoft saying "you grant to Microsoft a worldwide and royalty-free intellectual property license to use Your Content" makes me wonder exactly *which* Microsoft tool I'm using that lets them use all my stuff. 🤔

That is, this is not Napster. OpenAI hasn’t ‘pirated’ your book or your story in the sense that we normally use that word, and it isn’t handing it out for free. Indeed, it doesn’t need that one novel in particular at all. In Tim O’Reilly’s great phrase, data isn’t oil; data is sand. It’s only valuable in the aggregate of billions,, and your novel or song or article is just one grain of dust in the Great Pyramid. OpenAI could retrain ChatGPT without any newspapers, if it had to, and it might not matter - it might be less able to answer detailed questions about the best new coffee shops on the Upper East Side of Manhattan, but again, that was never the aim. This isn’t supposed to be an oracle or a database. Rather, it’s supposed to be inferring ‘intelligence’ (a placeholder word) from seeing as much as possible of how people talk, as a proxy for how they think.

On the other hand, it doesn’t need your book or website in particular and doesn’t care what you in particular wrote about, but it does need ‘all’ the books and ‘all’ the websites. It would work if one company removed its content, but not if everyone did."

: "- Bring opt-out mechanisms to platforms where the data is shared. Buried in user agreements are clauses that give these platforms rights to train AI systems with users’ images (or text). If users aren’t comfortable with a platform’s policy on AI, they ought to be informed and able to opt out without consequence.

- Acknowledge that people generate images – not AI. Every AI-generated artwork is a product of some human intention, and subsequent interaction, with a tool to manifest that intention. Attributing authorship to the tool, rather than attributing it to an interaction of users, tools, and data, wrongly shifts accountability to the tool instead of the humans who build and use them. Designers of these tools ought to be accountable for their decisions in building them. There are content moderation decisions already at work, such as the blurring or censorship of inappropriate images.

- Empower data consent. If users of a company’s tools or an open source model create a “dataset” of images by a particular human artist without permission, or include large numbers of an artist’s work in a larger dataset, then the designers of those tools or models should be held accountable. There is an obligation to provide clear assurance that consent has been obtained for the data used in training datasets: just as one would in any ethical research endeavor.

- Affirm data rights as well as copyrights. There are limits to copyright law, which has long been flawed and over-restrictive to creative reinterpretation – and assumes that the court system is equally accessible to everyone. Placing the focus on the users who create outputs with AI tools is akin to faulting drivers when a vehicle malfunctions. Individuals who make and share AI-generated work should not be afraid of prosecution if these tools infringe another artist’s copyright"

Mit künstlicher Intelligenz können technische Probleme gelöst werden. Aber können diese Lösungen dann patentiert werden? Kann die Erfinder sein? Wem gehört die Erfindung? Nach wohl herrschender aktueller Meinung gibt es zumindest in Europa keine „Erfindungen“ ohne menschliche (Mit-)Erfinder. Ein Patent würde nicht erteilt, müsste wohl widerrufen oder für nichtig erklärt werden. Jedenfalls kann die KI selbst nicht Rechteinhaber werden.

BUT I also found the lack of mention of AI, theft of ideas/IP through LLM scraping, and the inclusion of several images attributed only to MidJourney pretty jarring.

Those images are clearly generated in a particular style. I bet the prompt used to generate them had an artist's name in it. I wonder whose it was.
