It seems like an oxymoron, but could non-disclosure agreements help the replicability of research?
[Detail in a reply. Those more versed in intellectual property law might be able to tease out how this proposal is different from a material transfer agreement - Matt]

Great read in The Verge this week breaking down a cluster of class actions being brought against OpenAI and Meta regarding how they went about training their LLM models.

Hi! My second toot, I just realised I should probably actually introduce myself for my introduction, rather than just stating I'm new so here goes:
I am a jurist from the Netherlands🇳🇱 specialising in IP law. I love boardgames and tabletop games and also racket sports and Formula 1.
I'd love to hear recommendations on who to follow for F1 related toots!

@ppopiel The lead complaint according to the article is that Google is trying to monopolize the market for ad technology. I presume they're doing this by using intellectual property law tools like patents and copyrights. Isn't the point of patent's and copyrights to allow a temporary monopoly on inventions and expression to incentivize it?

I am not entirely sure how to feel about this but it does bring up to me a lot of interesting questions about the value of #art and how we should value art and #FairUse https://www.artnews.com/art-in-america/columns/supreme-court-andy-warhol-decision-appropriation-artists-impact-1234669718/

What are your favorite articles about #GenerativeAI and #IntellectualProperty?
One I really love is from my colleague Ryan Merkley in Lawfare which really approachably explains some of the backstory on these thorny questions: https://www.lawfareblog.com/ai-generated-works-artists-and-intellectual-property

With Milan getting the third central division (with #Paris, #Munich), we now have an extremely central #Europe and civil-law based top end of the #UPC.
Coupled with #Brexit and #Ireland's deferred ratification, this means the hard-fought common-law provisions will be consigned to history long before Ireland joins.

Interesting TTAB case: Chooseco v. Super73 (No. 91284139). Core products differ significantly (books v. ebikes), but Chooseco's likelihood of confusion claim hinges on licensed promotional merch. Flip to page 11 to avoid confusion! #iplaw #trademarks #lawfedi

Here's an interesting #trademarks story: a dispute over the term "Worship Leader" between a church-related magazine and a meme account.
