If an AI accepts a EULA and nobody is there to manifest assent, does it make a contract? Nope, but then again, consumer assent to clickwrap/browsewrap agreements is already mostly pretend. ICYMI along with measuring how similar 2 trademarks are perceived by consumers' brains, this also revealed aspects of trademark perception, such as visual processing, memory retrieval, "affective evaluation" and more. #trademarks #iplaw #ipprofs #intellectualproperty

The USPTO has granted hundreds of TM regs that include "Patented.” Even if it’s true at registration, it will eventually be false. Maybe time-bomb TMs like this should be barred? (Or maybe it’s just not a big deal…) @design_law #trademarks #patents #lawfedi #ipprofs
