The just handed down a *landmark* ruling - the case - that "brought back from the dead."

At issue in *Cemex* was what the should do about employers that violate during union drives. For decades, even the most flagrantly illegal union-busting was met with a wrist-slap.

"[T]he number of kids at work in the United States increased by 37 percent between 2015 and 2022. During the last two years, fourteen states have either introduced or enacted legislation rolling back regulations that governed the number of hours children can be employed, lowered the restrictions on dangerous work, and legalized subminimum wages for youths."

The Teamsters unionized Amazon’s drivers
Though the victory is more than a quiver
But US labor law, now quite out of date
Makes the outcome of this case quite hard to calculate
What happens, and if it sticks, we will all see
When Amazon, Teamsters, and courts all agree

Over on the LP&E Project blog, there is an interesting post on the toll religious accommodations can take on worker solidarity, a collision of interest implicated in Groff v. DeJoy, on which SCOTUS will hear oral argument next week. A summary and some thoughts . . .

Labor Laws in Japan make it very difficult to fire people. Termination is assumed to be unjustified unless the company can prove the employee committed crimes or just never showed up for work. If the company is bankrupt that is also an acceptable reason. If the company is still on it's feet, there is no excuse for dismissing employees. Wrongfully fired employees can file paperwork with the unemployment agency and can get paid a year or two of wages as compensation. If a Japanese company in Japan wants to dismiss you, they negotiate a resignation with you and often pay several months of wages as compensation. This keeps unemployment rates very low.
