Does anyone have insight into how to set up a "feeder organization" - a business where all profits are donated to charity in the US? Or can recommend a good person who might know?

This week in Insights I talk about the success of the WA capital gains tax, and what it might suggest for other states facing budget crunches. Read: Don't hike sales tax, opt for cap gain.

"In 2021, WA passed a 7% capital gains tax on the sale or exchange of stocks, bonds, or other assets in amounts greater than $250k. The tax was expected to bring in as much as $250m in its first full year. Actual receipts totaled nearly $850m.”

My kids' elementary school just started using a new app for various attendance and school pickup related matters. It seems fine. But, being a lawyer, I of course had to review the privacy policy, which expressly states that to ensure compliance with COPPA, the app is not directed at children under the age of 13 and that children under 13 are not permitted to use the app. Sigh.

Is it me or is PACER super slow these days? You'd think a website charging 100s of times more than average would be able to keep its servers up to speed.

The excellent atty for plaintiffs concludes with two more args

On the right being limited to info: To interpret the right to privacy so narrowly would destabilize many other rights that have relied on it, like parental rights

On the concern about the unborn: If you overrule, you would be allowing the state to force someone to take on increased risk and harm for the sake of others, which is unprecedented.

Oh, I should mention that the state's attorney, bless him, was not as adept as she, and argued that the right to privacy in the Florida state constitution, a provision that again, reads : “Right of privacy: Every natural person has the right to be let alone and free from governmental intrusion into the person’s private life.”
he argues that it covers only informational privacy

Atty has answers:

The voters had a chance to overrule abortion rights, and they didn't

There is no need to go beyond the plain meaning of the text

Roe was well known

Court cases, which also contribute to original public meaning, clearly recognized right to privacy as incl abortion

To overrule precedent, the precedent must be clearly erroneous

[There is more]

The justices of the Florida S. Ct. try to argue againt this reading of the right to privacy in the Florida const by pointing out there was not much discussion of abortion in the legislature or popular press at the time the Const was amended to include it, and surely there would have been had a constitutional right to been on the table.

I.e. if they reach the merits, they will argue there is no evidence that the original public meaning included a right to abortion

Arguments have started!

Plaintiff for women tries to make her argument, but keeps getting interrupted with procedural questions.

is the Florida Supreme Court trying to reject the challenge without being obviously political?

Unfortunately, like the U.S. Supreme Court, the Florida Supreme Court has taken a sharp turn to the right

But unlike the U.S. Supreme Court, the Florida Supreme Court must contend with an explicit right to privacy in the state's constitution.

This morning, the Florida Supreme Court will hear oral arguments on whether to overrule well established precedent that the Florida Constitution's explicit right to privacy protects a right to abortion

The right to privacy in 's Constitution states: “Right of privacy: Every natural person has the right to be let alone and free from governmental intrusion into the person’s private life.”

@jsrailton Is there any chance the DOJ is looking into these communications with a foreign power? Has he violated the FARA act with this? Or the sanctions in some way?

If the Florida Supreme Court uphelds the fifteen week ban, then a month later a six ban goes into effect, virtually eliminating the right to abortion in the State of Florida.

Abortion access on the line in Florida before DeSantis-heavy Supreme Court tallahassee.com/story/news/202

Florida's Constitution contains an explicit right to privacy, and the Florida Supreme Court has repeatedly held that the Fl Const protects the right to abortion.

Unfortunately, Florida's Supreme Court has gotten very conservative, and tomorrow will hear arguments on Florida's 15 week ban.

The Fl S.Ct. is expected to uphold it, paving the way for a 6 week ban
