Republicans then began trying in every way possible "to game the process of adjudicating abortion laws" and avoid popular referendums, since they knew they were on the losing side of the abortion issue.

"So, instead of letting states decide, as they’d championed for so long, Republicans are often trying to limit how voters weigh in at all."

And this is what the Ohio battle was all about.

As Philip Bump notes, for a long time, Republicans have argued decisions about abortion should be left up to the states, to a popular vote — because Republicans assumed (erroneously) that a majority of people wanted abortion rights abolished and abortion outlawed.

But once the Dobbs decision was handed down, with the Supremes saying this is all best left to the states, Republicans changed their tune.

"The defeat of Issue 1 also represents a major victory for one-person, one-vote democracy, at a time when the extreme right-wing forces that now dominate the Republican Party have made it abundantly clear that they will stop at nothing to prevent voters from rejecting the party’s candidates and its agenda."

Will the Ohio legislature simply ignore the passage of a pro-choice measure in November?
"Ohio Republican legislators set a special election in August to require more signatures to get a constitutional amendment on the ballot and a threshold of 60% of the vote... for the amendment to pass...
... two amendments that tried to stop political gerrymandering...passed with about 75% of voters…and the Republicans ignored them."

"The Dobbs ruling has turned a coalition of liberal, swing and moderate Republican voters into a political force. Even in August in Ohio."

"Ohio’s Issue 1 was one of the most blatant and cynical power grabs. It underscored the suspicion, now shared by many voters, that the GOP knows it can’t win by the rules and so either tries to change those rules mid-game or cries 'fraud' when it loses.

That has left a sour taste in the mouths of many voters, including independents and persuadable Republicans."

The win in Ohio, amazing as it is for progressives in a traditionally red, Trump-voting state, also carries many important takeaways with implications for the future of democracy in Ohio and for big national battles in 2024."

"The election resulted in a resounding rejection of Republican electoral tricks and of minority rule, and it was a strong indication that voters are exhausted by and have had it with GOP extremism on abortion rights and other cultural and social issues."

I'm late to understanding this, but others have been talking about the slide to minority rule for 3+ years.

This article talks about it, The Atlantic has done a number of articles on the slide toward minority rule :masto_love:

David Rothkopf thinks that even if Trump loses in court or in 2024, our system will remain profoundly broken — due to

"a decades-long systematic effort by those on the right to promote minority rule in America and, in particular, to ensure that the interests and power of a small fraction of Americans—primarily rich, white, Christian men—would remain protected."

The lecture attached above (in Teri Kanefield's post) should be required reading for all Americans.

This Harvard professor clearly distills exactly what is going on in our country politically now, and connects it to our Constitution -- so that we can understand how we got into this mess. So well-written and accessible and not overly lengthy.

"In just the past three years, the court has sided with a religious foster-care agency that refused to certify same-sex couples as foster parents; a religious group that wished to fly a Christian flag over Boston’s City Hall; religious schools in Maine that sought public subsidies;"

"Our system is supposed to function by way of majority, elected rule—and not via edicts from a star chamber. Interference in the legislative or executive process is rightfully viewed by many as a power grab, especially when the Court’s decisions are doing the heavy lifting for the party out of power. It is a form of minority rule, and it is antithetical to democratic principles."

"Among the most notable new features of Chief Justice John Roberts’s Court is a willingness to insert itself into matters traditionally reserved to the legislative or executive branches, substituting its own judgment for that of Congress or federal agencies.

This is a particularly troubling development for any democracy."

The 2 presidents that lost the popular vote appointed the 5 justices who joined Thomas to end consideration of race in college admissions. (oh, and the last 3 were appointed by a guy charged with 70+ felonies🤦🏻‍♂️)
