In simple terms, the use of the #Charter's #notwithstanding clause is an admission that the law cannot be defended as a reasonable limit prescribed by law that can be demonstrably justified in a free and democratic society.

I'd like to know what #Trudeau is going to do about the misuse of the #notwithstanding clause. It is way too important to let it be chipped away by the Premiers. Ford must be forced to explain the his rationale before the #SupremeCourt. #cdnpoli

From some of the comments from the Chair of the #OLRB as quoted in this article, the union may be concerned that he's leaning towards declaring the #protest an unlawful #strike under the #Ontario #Labour Relations Act #notwithstanding the fact that the collective agreement was imposed by legislation and not negotiation and arguments that this is a political protest.

Courts have found that collective bargaining is protected by the #charter.

Then the #Ontario government uses the #notwithstanding clause to get around that, vowing fines of $4000 per worker who participated in the #school strike.

But they’ll need the courts to enforce the fines.
