If this #precedent doesn't get the #Judge forcibly retried and the people freed and compensated, then I guess #France is a #NoGoArea for anyone who actually cares about their #HumanRights like #Privacy and #PresumptionOfInnocence as well as #RightToRemainSilent!

This is a good time to remember that all Americans are entitled to a presumption of innocence. As the United States Supreme Court pointed out in 1895, in the case of Coffin v. United States:

Addressing *that* issue would put a significant burden on the legal system, from how #lawenforcement responds to such complaints, to changes and new procedures in recording and indexing, and on making sure the information is available when needed (in this case, for #backgroundchecks).

But the biggest blow by far is to the underpinning #presumptionofinnocence.

At rock-bottom, it seriously undermines a foundation and #axiom of U.S. law: the #presumptionofinnocence. Basically, it suggests that something that had no legal effects, much less consequences, at the time should nevertheless affect future interpretation of the individual's rights, privileges, and life choices.
