TRUE - at least the AAM needs to be available in OA under a CC-BY licence, the VoR can be behind the publisher's paywall. This could arise if you were to apply the statement: “This research was funded in whole or in part by the [Funder][Grant number]. For the purpose of Open Access, the author has applied a CC BY public copyright licence to any Author Accepted Manuscript (AAM) version arising from this submission."

So, I have some news about my CC-BY submitted paper, applying a rights retention strategy to by-pass the copyright transfer to the publisher (Springer in this case).

We have a mixed outcome.
