It is astonishing how many books on the #medieval shari`a address socio-legal questions seemingly only on the basis of normative texts. The result is drastically different intuitions about "what really happened" in law and society, with very little appeal to descriptive evidence. Of course we don't have nearly enough evidence, I know! But we do have some (I think of books by Kristen Stilt and by Lev Weitz as positive examples here), and it could be used more.
