"The Thacker Pass protesters who were hit with a lawsuit filed by Lithium Nevada are seeking to get the case dismissed. The defendants last week filed a motion to dismiss the case claiming they were exercising their right to free speech.

"Lithium Nevada, which is building the Thacker Pass lithium mine, sued the protesters in late June.

"The company said activists and members of the Fort McDermitt Paiute Tribe have attempted to block construction at the mine site.

"'Despite multiple warnings from law enforcement not to block public roads, Defendants have continued to do so,' the lawsuit alleges. 'Indeed, Defendants have proudly broadcasted their defiance of law enforcement on social media.

"The defendants disagreed with Lithium Nevada’s claims.

"'The Defendants opted to exercise their constitutional rights and went to the Mine site to pray for their ancestors as destroyed those ancestors’ final resting places, destroyed culturally significant lands formerly used for subsistence and self-preservation,' they wrote in their motion. 'It is appropriate to analyze whether LNC has established the elements of its claims for relief within the limitations imposed by the First Amendment.'

"They also disputed LNC’s claims of violence and vandalism.

"'As a site is being bulldozed, non-violent protesters are being criminalized by a foreign mining company,' said attorney Terry Lodge, representing the defendants. 'My clients were engaged in that is clearly protected by the U.S. Constitution. This is greed and bullying.'"

But despite lawsuits, rallies, regulatory hearings, and community organizing, Lithium Nevada Corporation has now begun construction of the mine at the place Paiutes call “Peehee Mu’huh,” or rotten moon.

"But the construction has not gone unopposed. On May 11th, Native Americans from the Fort McDermitt - and other regional tribes set up a tipi at Thacker Pass and began prayers directly in the path of the construction of ’s water pipeline. Groups of Native Americans and allies have blocked mine traffic from accessing portions of the construction site for over a week now."

"'It’s an important place not only because a terrible massacre occurred, but also because it’s a place where people gather, it’s a place for ceremony, for hunting,' said Michon Eben, tribal historic preservation officer for the Reno Sparks Indian Colony, a government that includes members from the the , and tribes. The colony is advocating for Peehee Mu’huh to be on the National Register of Historic Places. 'It’s really hard to be a tribal member and see our homelands destroyed,' said Eben.

On February 6, a federal judge in Reno ruled that the BLM had complied with federal law in approving the mine, with the exception of one matter regarding waste disposal, which the judge ordered the BLM to revisit. The plaintiffs filed an appeal in the 9th Circuit and an emergency motion to block construction before the appeal hearing. The appeals court rejected the injunction and set the hearing date for June. "

"The scientists concluded the risk of a worst-case scenario — radiation released somehow into the air or getting into — was on the order of a million-to-one. That's the figure in the licensing application now before the U.S. Nuclear Regulatory Commission.

"Such an event likely would take thousands of years to occur, said licensed nuclear engineer Charlotta Sanders. She is an associate research professor at the University of Nevada, Las Vegas, and formerly an engineering specialist and group supervisor on the project.

"But this latest paper calls that early research on risk into question. The author, geologist Scott Tyler of the University of Nevada, Reno, said water movement models used to calculate those risks are out of date. Measurements taken since then show water is moving much faster than earlier estimates had calculated. The public deserves to feel confident the project would work as designed, he added.

"'Yucca Mountain could easily show some contamination in a very short period of time,' added Tyler, perhaps within 100 years.

"Tyler reviewed research by dozens of scientists published over the past 25 years. He found that many surprises have popped up regarding water movement within Yucca Mountain. His conclusions were published in January in the journal Geosciences.

"'There are so many loose threads,' Tyler said of research at the site. 'You pull any one and it stops the repository because there are enough uncertainties and questions.'"

"Although they are still investigating the area, the DOE is no longer looking for a site elsewhere. The tribe is extremely concerned about observed health and environmental effects on its members, but currently the federal government has not initiated or implemented any official health studies, remedies to the environmental pollution, programs for early detection of environmental disease, or disease surveillance programs.

"Authorities such as the Bureau of Land Management, Forest and Park Services, Fish and Wildlife, Atomic Energy Commission, Department of Defense, and Department of Transportation, now have control over 90% of Shoshone land. This is in direct violation of the 1863 Treaty of Ruby Valley, ratified by the U.S. Senate in 1866, and later upheld by President Grant in 1869, that recognizes Shoshone territorial . "

The U.S. establishment in industry and government has, since 1987, focused on geologically unsuitable Western Shoshone Indian land in Nevada for opening the world’s first permanent burial dump for highly radioactive nuclear waste. Yucca’s rock, fractured by earthquake activity – not to mention nuclear weapons blasts at the nearby Nevada Test Site – would allow radioactivity to massively leak out into the underground drinking water supply over time. Only by undermining public health and safety protections and weakening scientific guidelines and environmental regulations, again and again, has the nuclear establishment managed to keep the proposed Yucca dump from being disqualified from any further consideration.
