Supreme Court's 'Illegal But Permissible' Jurisprudence

A noticeable pattern can be seen in some of the recent decisions whereby the Supreme Court holds certain actions to be illegal but allows them to continue. The end result is that the relief becomes merely academic - a declaration of illegality with no real world consequence - and the wrongdoers get to reap the fruits of their wrongful actions. The SC on Thursday allowed Enforcement Directorate director Sanjay Kumar Mishra to continue till September 15 for the ongoing FATF review exercise "in national interest". The SC had earlier set July 31 deadline for current ED chief's tenure.However, the top court made it clear that no further extension would be granted to S K Mishra under any circumstance. "Mishra shall cease to be director ED from midnight of Sept 15-16," said a 3-judge bench led by Justice B R Gavai.
