Tonight is a mix of magic and theater 4 levels down in the bowels of the old Port Authority building, Lucas Hnath's A Simulacrum at Atlantic's Stage 2.

Quick wrap up. By my rough count 87 amendments (not counting technical amendments arising within a grouping, but counting associated amendments) were debated out of the 155 submitted. So the Committee is well on track to finish on Day 2

Of the 87 amendments I've a rough count of 33 that passed. Of those 33 a number are consequential amendments, so that's not a surprising figure

Karen Adam speaking against Michael Marra's amendments. Points out that the amendments are very middle-class and not inclusive of people from various different backgrounds. Also points out that the Michael Marra amendments are gatekeeping, not safeguarding

Minister responds, pretty much covering all the same objections as above

Michael Marra wraps up and presses the Amendment 45 to a vote

Amendment 45 moves to a vote and fails 2–4–1

And as this is where I came in yesterday I'll loop the thread back around to that point

Next up. What the Bill now looks like with the accepted amendments BUT this is not the final redrafted Bill as the Committee still has at least one more day to go through the next set of Amendments

Amendment 121 pressed to a vote, but Amendment 91 must first be disposed of as a matter of pre-emption

Amendment 91 goes to a vote and falls 1–6. Amendment 121 can now be voted on as pre-emption has not occurred

Amendment 121 goes to a vote and succeeds unanimously

Amendment 44 as debated with 18 moved to a vote. Vote is 3–3–1 so the Convener casts the breaking vote for the amendment. Amendment succeeds

Amendment 122 debated with 121. Moved to a vote and passed unanimously

Amendment 45 grouped with amendments and debated

The amendments by Michael Marra seeks to "address concerns by the broad public regarding the robustness of the legislation and we're absolutely clearly that Scotland requires a better system for trans people". And here comes the ", but" in that claim. The amendments seek to make the application process mirror the process for applying for a passport in that an applicant must get a member of good standing in the community to sign off on the application

Well guess what, matey. **** you, trans people know who we are, we don't need the cis to verify us. We certainly don't need members of a transphobic society to decide whether or not to sign off on our application

Amendment 154 as grouped with other amendments. This is Pam Duncan-Glancy's amendment that is an additional to her previously successful amendment around statutory declarations

Pam Gosal called to speak on the amendments called. Strangely enough the Tory is all for making trans people beg for our rights. **** the **** off. And take a radish with you

Maggie Chapman now talking on the amendments. Is unsurprisingly against Michael Marra's amendments given that they go against the point of the Bill which is self-declaration as agreed by 2/3rds of Holyrood at Stage 1

Fulton MacGregor speaking against Michael Marra's amendments as the analogy to passports for the purpose of obtaining a GRC is faulty

(currently getting ear-wormed with Unholy. Not a bad thing to be ear-wormed by as I go through the video stream from yesterday 😂)

Amendment 121 called to debate along with grouped amendments. This amendment is by Pam Duncan-Glancy and is the reinvention of the wheel. If accepted it would make it an offense to knowingly swear out a false statutory declaration. Except under the Statutory Declarations Act 1835 it is an offense to knowingly swear out a false statutory declaration

Pam Duncan-Glancy states that she's brought these amendments to help build support for the Bill

Amendment 22 called to debate along with amendments in that group

Graham Simpson's amendments are to make it a criminal offense to knowingly make a false statutory declaration and to define what is making a false declarations. Again, wheel, declaration, Statutory Declarations Act 1835, courts are there to make the decision on whether a statutory declaration was falsely made

Minister responds to these amendments. Speaks for Pam Duncan-Glancy's amendments on the reason of ensuring that potential applicants know the law. I don't think that's a good reason, frankly, and placing a provision in an Act that replicates the function of another Act is merely a recipe for bad law to potentially be created down the line

Minister points out that the Bill as drafted already lays out potential responses to making a false statutory declaration

Minister points out that 'living in an acquired gender' already has a definition under existing law, both statutory and common law

Amendment 39 as debated with 18. Moved to a vote. Vote is 3–3–1 so the Convener casts the breaking vote for the amendment. Amendment succeeds

Amendment 40 as debated with 18. Moved to a vote. Vote is 3–3–1 so the Convener casts the breaking vote for the amendment. Amendment succeeds

Amendment 41 as debated with 18. Moved to a vote. Vote is 3–3–1 so the Convener casts the breaking vote for the amendment. Amendment succeeds

Amendment 118 as debated with 114 is not moved to a vote and falls

Amendment 119 as above and not moved to a vote and so falls

Amendment 120 debated with 118 is not moved and so falls

Amendment 42 as debated with 18. Vote is 3–3–1 so the Convener casts the breaking vote for the amendment. Amendment succeeds. Amendment 19 is now pre-empted and won't be called

Amendment 90 debated with 83. Amendment not moved to a vote and so falls

Amendment 43 as debated with 18 moved to a vote. Vote is 3–3–1 so the Convener casts the breaking vote for the amendment. Amendment succeeds

Amendment 91 debated with 87. Amendment moved, but not voted on as amendment 121 needs to be debated first due to a matter of pre-emption

And the Committee heads into a break

And it is indeed the next day, so onwards and sideways as I wrap up on yesterday's Stage 2 Committee hearing

Amendment 87 and all amendments in the group. This is the amendment by Maggie Chapman that would remove the waiting periods in the GRC process. Personally I'm fully in favour in this, but sadly this will never make it pass the cis who oh-so love gate-keeping trans people out of some simple respect and dignity, instead preferring to us to wait just in case we change our minds and start being properly cis

Vote on Amendment 87 and all grouping amendments falls 1–6

Amendment 88 already debated and moved to a vote. Fails 1–6

Amendment 38 already debated with 18. Moved to a vote. Succeeds on a vote of 3 for, 3 against, 1 abstention. Convener casts the breaking vote for the Amendment. Amendment 38 succeeds

Amendment 89 called as debated with 87 and moved to a vote. Amendment fails 1–6

Amendment 3 as debated with 2 and moved to vote. Amendment falls 2–6

Section 3 agreed to

Amendment 116 (debated with 115) called to be moved or not moved by Tess White

Amendment 116 moved and goes to the vote

Amendment 116 fails 3–4

Amendment 86 (debated with 83) not moved

Section 2 is agreed

Amendment 117 called (previously debated with amendment 18). Amendment not moved

Votes on this grouping now ended

I'll cover the next grouping of amendments either later on this evening or tomorrow, but I do feel that this is quite enough for now 😅

Minister otherwise speaks against the other amendments

Pam Duncan-Glancy asks that the Minister consider an alternative to her amendment, and further asks the Minister to work with her to find a way forward

Pam Duncan-Glancy presses her amendment to seek the depth of support to include asylum seekers within the scope of the Bill as being ordinarily resident in Scotland at Stage 2

Vote on amendment 115 passes 4–3. A good call and vote. Work will be needed around phrasing of this in the Bill at stage 3, but all-in-all that's a bloody good win \o/

(Private moment: FUCK YESSSSSS!!!!!!!)

(Also private moment: Oh so fittingly I now have an Oot! button instead of a Publish button and, no, I didn't do that change 🤣)

[Insert Minister dunking on the above bollocks claiming to be 'genuine concerns']

Move to vote

Amendment 2 falls at 2–5

Amendments 84 and 85 not moved

Amendment 115 grouped with 116 called to be moved and debated

Pam Duncan-Glancy called to speak on the Amendment which includes asylum seekers as people who should be included as people resident in Scotland for the purpose of applying for a GRC

Amendment 116 seeks to have Scottish Ministers define what 'ordinarily resident in Scotland' means

Note that this is already defined in Scottish law, including in 17 Acts specific to Holyrood, and used in Acts passed by Westminster

Rachael Hamilton speaks in support of the amendment to include asylum seekers resident in Scotland to be included as people who can apply for a GRC

Minister responds pointing out that the term 'ordinarily resident in [XXXX]' is already well recognised in law

Minister responds to amendment 115 matters of those seeking asylum in the UK are matters not devolved to Holyrood and that as a result asylum seekers cannot be said to be seeking asylum in Scotland in particular. Unfortunately, as such, the Minister asks that the amendment not be taken up

Rachael Hamilton to speak on similar amendments that seek to maintain the same requirements to provide evidence in line with the original GRA2004

Just as pointless as Sue Webber's one, and that's all the coverage it needs, especially as it again drags in canards about access to medical healthcare, gender dysphoria must be something the applicant is experiencing when applying, etc, something, something, puberty blockers

Yeah, utter bollocks

Amendment 2 from Sue Webber is now called, plus all grouping amendments

This amendment is utterly ridiculous. It changes section 2 of the Bill to say that Scottish applications for a GRC must go to the Gender Recognition Panel, delete rest of Bill. In other words, it's an amendment grouping to stop the Bill from functioning at all

The reason why these amendments draw such scorn is that the MSP and others are perfectly free to vote against the BIll at Stages 1 and 3. Stage 2 is not the place to waste time on self-promoting bollocks that nobody's ever really going to see beyond wonkette's like me

Prediction: Amendment will fail, 2–5

[gap of pointless amendment debate, Minister response, and wind up]

Minister also notes that the current list of recognised countries hasn't been updated in 10 years and doesn't recognise countries that have enacted policies that allows a person to have their self-defined sex recognised and accepted by the state that they obtained the aforementioned in

Minister goes on to state that her amendments provide for automatic recognition for change of gender elsewhere in the UK, or otherwise outwith the UK, and a mechanism to change that should a country end a process of recognising a trans person's sex in law

Roz McCall on wind-up and withdraws her amendments
