The 1893 case of Nix v. Hedden ruled that tomatoes are vegetables, not fruits, for tariffs, imports, and customs.

The Supreme Court used the ordinary meanings of the words rather than the botanical definition.

Fruit merchant Nix sued customs inspector Hedden over a tomato tariff, but the Court sided with Hedden, stating that fruits and vegetables had no special meaning in commerce.
