Kilka lat temu zrezygnowałem z #Play, bo zaczęli być po prostu drodzy. Po różnych perypetiach od 2 lat mam wszystko w #UPC. Tymczasem UPC zostało przejęte przez Play i tym samym wracam do Play. Mam nadzieję, że nie będą grzebać w ofercie, bo z jakości i ceny obecnych usług jestem bardzo zadowolony.

That last EU commission toot reveals they do not understand/care-about the #UPC . Maybe fair enough, as it is not an EU instrument.

The European Patent Office, EPO, based on the EPC (the EPC predating the EU), helps* EU inventors obtain/register patent protection across EPC states.

Even limited to enforcement of #patents, the actual focus of the UPC, it is not a one-stop shop. Hell, the UPC only covers 17 of the EU states.

* = in recent years, whether it "helps" is arguable.

What is most depressing is the #UK done all the hard work in getting the #UPC states to include (UK and Irish) common-law provisions in the UPC Rules. The UK then threw the advantages of this work by withdrawing after Brexit.

#Ireland was thus handed by the UK/Brexit a once-in-a-lifetime opportunity to carve our own niche in the valuable world of European IP litigation.

Our politicians' crippling lack of ambition and backbone was so severe that we did not even fight for it.

With Milan getting the third central division (with #Paris, #Munich), we now have an extremely central #Europe and civil-law based top end of the #UPC.

Coupled with #Brexit and #Ireland's deferred ratification, this means the hard-fought common-law provisions will be consigned to history long before Ireland joins.

On 1st June, a new European patent Court (the #UPC) opens. It will focus on #patents and SPCs.

Whilst all the signed-up UPC states are in the EU and bound by EU law, in the torturous UPC negogiations, one point was agreed early: that the UPC should be separate to EU law to avoid, to the extent possible, the ECJ ballsing up European patent law.

Now, right before the Court opens, the EU has decided to nobble legal certainty in European patent in a brand new way.
