This constant rangling over enforcement jurisdiction is why we need to replace "The Clean Water Act," which is just a set of amendments to a pollution control act and therefore about limiting dirty water, not ensuring clean water, with a Right to Clean Water and then define clean water. Then states would have to enforce it on their own. It's inane that clean water isn't a basic federally protected right in the US.

A Ninth Circuit panel on Tuesday revived a Trump-era Clean Water Act regulation, finding the lower court lacked authority to vacate the rule without finding it unlawful.

In 2021, U.S. District Judge William Alsup vacated a Trump administration revision of the “Clean Water Act 401 Certification Rule,” which narrows what issues state and tribal governments can consider when determining whether a project, particularly one discharging #pollution into a waterway, complies with state #water quality standards.

The rule affected the #permitting and relicensing process for thousands of industrial projects, including natural #gas pipelines, hydroelectric plants, #wastewater treatment facilities and construction sites near sensitive #wetlands.

The National Cattlemen's #Beef Association announced this morning it would file a lawsuit challenging the Biden Administration's newest definition for Waters of the U.S. (#WOTUS). The announcement comes a day after the EPA and Army Corps of Engineers formally published their new rule in the Federal Register. The new rule would take effect March 20th barring any court action.
